Terms of Service

These Terms of Service (“Terms”) govern your access to and use of 6to9 — the website at 6to9.ai and the related product, browser extension, and services (together, the “Service”), operated by 6to9 (“6to9,” “we,” “us”). By using the Service you agree to these Terms. If you don’t agree, please don’t use the Service. This is a plain-language document; if any part is unclear, email support@6to9.ai.

1. Beta service

6to9 is in beta. The Service is under active development and is provided for evaluation. It may be incomplete, change frequently, behave unexpectedly, or be unavailable. We may add, modify, suspend, or discontinue any part of the Service — or your access to it — at any time, with or without notice, and we may set or change usage limits. We don’t guarantee any level of availability, performance, or data retention during beta.

2. What 6to9 does

6to9 helps you prototype and measure changes to web pages — including generating variants of a live page, suggesting metrics, and helping you set up experiments. Much of this is powered by AI models. The Service produces drafts and suggestions to assist you; it does not replace your own judgment, testing, or review.

3. AI-generated output

The Service uses large language models and other AI systems. AI output can be inaccurate, incomplete, outdated, or entirely fabricated (“hallucinated”), and the same input can produce different results. You are responsible for reviewing, testing, and validating any output before you rely on it, publish it, or ship it to real users.

  • Output is not professional advice (legal, financial, medical, or otherwise) and should not be treated as a guarantee of any result, lift, or business outcome.
  • We don’t warrant that output is accurate, original, or non-infringing — review it before use.
  • As between you and us, you own the inputs you provide and are responsible for the changes you choose to apply or deploy.

4. Acceptable use & your responsibilities

You agree to use the Service lawfully and responsibly. In particular, you agree that:

  • You will only prototype, edit, or run experiments on websites you own or are authorized to modify, and you will respect the terms, policies, and technical protections of any site or third-party service you use the Service with.
  • You will not use the Service to do anything illegal, deceptive, or harmful — including infringing others’ rights, scraping or accessing data without permission, impersonation, malware, or circumventing security controls.
  • You will not misuse the Service (e.g. attempting to disrupt it, reverse-engineer it beyond what the law allows, or overload it), and you are responsible for activity under your account.

5. Third-party sites & services

The Service is designed to work with websites and third-party tools that we don’t control. You are solely responsible for your use of the Service on any such site, including compliance with that site’s terms and applicable law. 6to9 is not responsible or liable for any consequences arising from how you use the Service on third-party sites, including any harm, disruption, or violation of a third party’s policies.

6. Your content

You keep the rights to the content and inputs you provide (your “Content”). You grant us a limited license to host, process, and use your Content solely to operate and improve the Service. You represent that you have the rights needed to provide your Content and to let us process it. How we handle personal data is described in our Privacy Policy.

7. Our intellectual property

The Service itself — our software, branding, and content (excluding your Content and third-party materials) — belongs to 6to9 and is protected by intellectual-property laws. These Terms don’t grant you any rights in the Service except the limited right to use it as permitted here.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, secure, or that any output will meet your requirements.

9. Limitation of liability

To the fullest extent permitted by law, 6to9 and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or goodwill, arising from or related to your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the three months before the claim, or USD $100. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to indemnify and hold 6to9 harmless from claims, losses, and expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your violation of these Terms or applicable law.

11. Suspension & termination

You can stop using the Service at any time. We may suspend or terminate your access at any time — especially during beta — if we believe you’ve violated these Terms or to protect the Service or others. Sections that by their nature should survive (e.g. disclaimers, limitation of liability, indemnification) will survive termination.

12. Changes to these Terms

We may update these Terms as the Service evolves. When we make material changes, we’ll update the “last updated” date above. Your continued use of the Service after changes take effect means you accept the revised Terms.

13. Governing law & contact
